5. Nature of the Service
Contenttosocial is a Software as a Service (SaaS) platform that turns text supplied by the User into branded visual assets (carousel images, PDF documents and single images) and publishes them, with the User's captions, to the social accounts the User connects.
The Service does not use artificial intelligence. It does not write, rewrite, translate or generate content; it lays out and formats exactly the text supplied by the User, with the User's brand settings. Publication is carried out through a third-party publishing provider using the official interfaces of the platforms.
6. Supplied Content and Publications – Warning
Important: everything rendered or published by the Service comes from the User. The User expressly acknowledges and accepts that:
- Contenttosocial performs no editorial review of the text, images or logos supplied, nor of the resulting publications.
- The automated technical checks applied by the Service (text limits, layout fit, format validation) are not a review of the lawfulness, accuracy or originality of the content.
- The User is solely responsible for verifying, validating and publishing their content, and assumes full editorial responsibility for it.
- The platforms may reject, remove, restrict or label a publication, or suspend an account, under their own rules, without Contenttosocial having any control over it.
- Posts published on the platforms are managed by the User from their accounts; the Service does not delete them.
7. No Warranty – Service Provided 'As Is'
The Service is provided 'as is' and 'as available', without warranty of any kind, express or implied.
Contenttosocial expressly disclaims all warranties, including:
- Any warranty of merchantability or fitness for a particular purpose.
- Any warranty of uninterrupted, error-free or secure operation of the Service.
- Any warranty that a publication will be accepted, displayed, kept online or shown to any audience by a platform.
- Any warranty regarding the permanent availability of the publishing provider, the hosting providers, the payment provider or the platforms.
- Any warranty of compatibility with all equipment, browsers, websites or operating systems.
The User uses the Service at their own risk.
8. Limitation of Liability
8.1 Best Efforts Obligation
Contenttosocial commits only to a best efforts obligation. Under no circumstances does it guarantee any particular result from the use of the Service.
8.2 Exclusion of Indirect Damages
Under no circumstances shall Contenttosocial, its officers, employees or contractors be liable for any indirect, incidental, special, consequential or punitive damages, including:
- Loss of profits, revenue, turnover, audience or business opportunities.
- Loss of data, files or system corruption.
- Damage to reputation, image or goodwill.
- Loss of customers, followers or contracts.
- Business interruption or loss of earnings.
- Cost of acquiring substitute services.
8.3 Liability Cap
The total cumulative liability of Contenttosocial, whatever the cause, shall in no event exceed the greater of: (a) the amounts actually paid by the User during the twelve (12) months preceding the event giving rise to liability, or (b) one hundred (100) euros. This cap does not apply to Consumer Users to the extent mandatory law provides otherwise.
8.4 Specific Exclusions
Contenttosocial expressly disclaims any liability for:
- The content supplied by the User and the publications made from it.
- Any infringement of third-party rights in the content supplied or published.
- Decisions of the platforms and changes to their interfaces or policies.
- Temporary or permanent unavailability of third-party providers.
- The User's website, clients or network.
8.5 Essential Nature
The above limitations of liability constitute an essential element of the contract, without which Contenttosocial would not have agreed to provide the Service at the current prices.
9. Indemnification
The User agrees to indemnify, defend and hold harmless Contenttosocial, its officers, employees, agents and contractors against any claim, action, damage, loss, liability, cost and expense (including reasonable attorney fees) arising from or related to:
- The User's use of the Service.
- The content supplied by the User and the publications made from it.
- Any breach of this Legal Notice or of the Terms of Service.
- Any violation of third-party rights, including intellectual property rights.
- Any fraudulent, illegal or unauthorised use of the Service.
This indemnification obligation survives the termination of the User's account.
10. Intellectual Property
The entire Contenttosocial website and its elements (source code, rendering engine, templates, architecture, design, interfaces, databases, trademarks, logos, trade names, texts, graphics, documentation) are protected by French and international intellectual property law and are the exclusive property of the Publisher or its partners.
Any reproduction, representation, modification, publication, adaptation, translation, extraction, commercial exploitation or reuse of all or part of the website's elements, by any means whatsoever, is strictly prohibited without the prior written authorisation of the Publisher.
The name, logo and wordmark 'Contenttosocial' and all other distinctive signs on the website are the property of the Publisher. Their unauthorised reproduction or use is prohibited.
The database structure is protected by the sui generis right of database producers (Articles L.341-1 et seq. of the French Intellectual Property Code). Any substantial extraction or reuse is prohibited.
11. Personal Data
Marketing Ops is the controller of your personal data within the meaning of the GDPR (Regulation (EU) 2016/679). You have the right to access, rectify, erase, restrict, port and object to the processing of your personal data.

12. International Data Transfers
In providing the Service, your data may be transferred to the following countries:
- United States: Vercel (web hosting), Stripe and Link (payments), Google (sign-in, if used), Resend (emails), AgentMail (support mailbox).
- Singapore: Supabase (provider support), with data hosted in the European Union.
- Spain (European Union): Zernio (social account connection and publication).
These transfers are governed by the following mechanisms in accordance with the GDPR:
- EU-U.S. Data Privacy Framework (DPF): European Commission adequacy decision of 10 July 2023 for transfers to certified providers in the United States.
- Standard Contractual Clauses (SCC): Commission Implementing Decision (EU) 2021/914 of 4 June 2021.
Despite these safeguards, you are informed that third countries may have legislation offering a level of data protection different from the European Union. By using the Service, you accept these transfers and the associated residual risks.
13. Third-Party Services
The Service relies on third-party services for its operation, including:
- Zernio Software SL – social account connection and publication.
- Supabase, Inc. – database, authentication and storage.
- Vercel, Inc. – hosting and infrastructure.
- Stripe and Sold through Link, LLC – payment processing, invoicing and taxes.
- Google LLC – sign-in with Google.
- The social media platforms on which publications are made.
Contenttosocial has no control over these third-party services and cannot guarantee their availability, performance or security. Any unavailability or malfunction may affect the operation of the Service. The User acknowledges that the use of these services is subject to their own terms and privacy policies.
14. Service Availability
Contenttosocial strives to keep the Service available 24 hours a day, 7 days a week, but does not guarantee continuous and uninterrupted availability. The Service may be temporarily unavailable due to scheduled or emergency maintenance, technical incidents on our infrastructure or that of our providers, changes to the platforms' interfaces, network problems or force majeure. Contenttosocial shall not be liable for the direct or indirect consequences of temporary unavailability.
15. Minimum Age and Capacity
The Service is exclusively reserved for persons aged eighteen (18) or older with full legal capacity. By using the Service, the User represents and warrants being at least 18 years old and having the capacity to contract. Contenttosocial does not knowingly collect data from minors; if it becomes aware that a minor is using the Service, the account is suspended and the data deleted.
17. Hyperlinks
The website may contain links to other websites. Contenttosocial has no control over them and disclaims any responsibility for their content, availability or data protection practices. Creating links to the Contenttosocial website is authorised provided they do not harm the company's image and are removed upon simple request.
18. Force Majeure
Contenttosocial shall not be liable for non-performance or delay in performing its obligations if it results from a force majeure event within the meaning of Article 1218 of the French Civil Code, including natural disasters, pandemics, wars, riots, acts of terrorism, general strikes, fires, floods, major Internet or telecommunications outages, major cyberattacks, government or regulatory decisions, and outages or decisions of third-party providers or social media platforms. If such an event continues beyond thirty (30) days, either party may terminate the contract without compensation.
19. Modification of the Legal Notice
Contenttosocial reserves the right to modify this Legal Notice at any time, in particular to adapt it to legislative or regulatory changes. Modifications take effect upon publication on this page; the date at the top indicates the current version. Continued use of the Service after publication constitutes acceptance.
20. Severability
If any provision of this Legal Notice is declared void or unenforceable under any law, regulation or final court decision, it shall be deemed unwritten without affecting the validity of the other provisions, which remain in full force.
21. Applicable Law and Jurisdiction
This Legal Notice is governed exclusively by French law, excluding its conflict of law rules.
For Professional Users (B2B): any dispute relating to the interpretation, validity or performance of this Legal Notice is submitted to the exclusive jurisdiction of the courts of Paris, notwithstanding plurality of defendants or third-party claims.
For Consumer Users (B2C): in case of dispute and after an attempt at amicable resolution, the consumer may bring the matter before the courts having jurisdiction under the general rules of law, or resort to mediation (section 22).
22. Consumer Mediation
In accordance with Articles L.611-1 et seq. of the French Consumer Code, Consumer Users may have recourse free of charge to a consumer mediator for the amicable resolution of any dispute. Before contacting the mediator, the User must have sent a written complaint to Contenttosocial at the contact address above and not have received a satisfactory response within two (2) months.
